Georgia Breath Testing

DUI lawyers know that this device has been the subject of much research and many articles for years. CMI is very closed-mouthed about this machine’s programming. What has been made public is that the machine uses infrared spectroscopy. It’s a big word, but basically it works by shooting a beam of light into a breath sample. The molecule of ETOH ethyl alcohol will absorb some of that light. Whatever light is not absorbed, the machine will measure, multiply it by 2100 and covert it to your BAC (blood alcohol content).
So what do Georgia’s best DUI defense attorneys know about this machine? They know that any compound containing the methyl group of molecules will absorb the 3.61 micron light wave. One compound of the methyl group is ethyl alcohol, which is found in alcoholic beverages. The more ethyl alcohol on your breath, the more light will be absorbed. But any compound in the methyl group will also absorb that light, not just ethyl alcohol! In fact, studies show that there are over 100 compounds on your breath that already contain this group.
How to Obtain Your Own Blood Test
If you’re not satisfied with the breath test results that the police gave you, you can get your own independent blood test. You’ll choose the facility to go to. At the hospital your blood will be drawn at your expense – but take cash because hospitals will most likely only accept this form of payment. They must use a special kit for DUI cases and give you your sample in a sealed box.
However, if you are going to jail, your sample will be left with the police officer. You must inform the officer not to take your test to the state crime lab if you don’t want them to have access to your test results.
